1. Acceptance of Terms

By purchasing or accessing the Total Knee Survival Guide (hereafter referred to as "the Course"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you should not purchase, access, or use the Course. These Terms constitute a legally binding agreement between you ("the User") and HealthWise Digital Media LLC, D.B.A. Total Knee Warriors ("the Company").

This includes, but is not limited to, any injuries, complications, or adverse outcomes resulting from the use or misuse of the information provided in the Course.

5. User Responsibility

The User assumes full responsibility for the application and use of the information provided in the Course. It is the User's responsibility to consult with their healthcare provider before implementing any strategies, exercises, or recommendations found in the Course. The Company does not assume any responsibility for the User's actions or decisions based on the information provided in the Course.

6. Indemnification

The User agrees to indemnify, defend, and hold harmless the Company, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with the User's access to or use of the Course.

7. Intellectual Property

All content included in the Course, including but not limited to text, graphics, logos, images, audio clips, video clips, digital downloads, data compilations, and software, is the property of the Company or its content suppliers and is protected by United States and international copyright laws. The compilation of all content in the Course is the exclusive property of the Company and protected by U.S. and international copyright laws.

8. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the state in which the Company is headquartered, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Course shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

9. Amendments

The Company reserves the right to modify or update these Terms at any time, and such modifications or updates shall be effective immediately upon posting on the Company's website or otherwise notifying the User. The User's continued use of the Course after such changes constitutes acceptance of the new Terms.

10. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

11. Entire Agreement

These Terms constitute the entire agreement between the User and the Company concerning the use of the Course and supersede all prior or contemporaneous understandings, agreements, representations, and warranties, whether written or oral, regarding such subject matter.
